Aimed at helping companies comply with California’s Do Not Track law, Attorney General, Kamala Harris, issued a new set of guidelines last week outlining how websites should report their tracking practices to users.
The guidelines, entitled Making Your Privacy Practices Public, are strictly voluntary. They are intended to assist mobile app and website operators comply with updates to California Online Privacy Protection Act (“CalOPPA”) that went into effect in January 2014. CalOPPA was amended by AB370, a bill sponsored by AG Harris and signed into law by California Governor Jerry Brown in September 2013.
The law requires operators of websites and online services that collect personally identifiable information about consumers to explain their do not track policies and procedures. It doesn't require the sites to honor do not track requests, but it requires websites to inform consumers if they disclose consumer data to third parties.
