FTC Enforces Do Not Call Registry against DISH

The Federal Trade Commission has filed a second complaint against DISH Network, one of the leading providers of satellite television service in the nation, for violation of the agency’s Telemarketing Sales Rule. The FTC alleges that since September 2007, DISH Network and authorized dealers calling on their behalf, have made millions of calls to consumers who previously stated that they did not want any telemarketing calls by the company. The FTC’s Telemarketing Sales Rule has provisions that prohibit telemarketers from calling consumer’s who specifically ask to be placed on a company’s do- not- call list, regardless of whether they are on the National Do Not Call Registry. On behalf of the FTC, The Department of Justice is currently litigating an earlier case against DISH Network for allegedly violating the Telemarketing Sales Rule by calling consumers on the National Do Not Call Registry.
