What is the Delaware Personal Data Privacy Act (“DPDPA”)?
The Delaware Personal Data Privacy Act (DPDPA), effective January 1, 2025, provides Delaware residents with rights to confirmation, access, correction, deletion, and a copy of their personal data, as well as information on third-party disclosures and the ability to opt out of targeted advertising, data sales, and profiling for automated decisions. The law is enforced solely by the Delaware Attorney General, with a 60-day cure period that ends on December 31, 2025. The DPDPA does not grant consumers a private right of action.
