What is the Oregon Consumer Privacy Act (“OCPA”)?
The Oregon Consumer Privacy Act (“OCPA”), effective July 1, 2024, grants Oregon residents rights to confirm, access, correct, delete, and obtain their personal data, as well as to opt out of its sale and targeted advertising processing. The law is enforced by the Attorney General with a five-year statute of limitations and does not allow for private legal actions by consumers. Notably, the OCPA does not include rulemaking provisions. An amendment effective July 1, 2025, will extend compliance requirements to nonprofits, and from January 1, 2026, controllers must recognize universal opt-out mechanisms.
