What is the Texas Data Privacy and Security Act (“TDPSA”)?
Texas passed the Texas Data Privacy and Security Act (“TDPSA”), which will take effect on July 1, 2024. With the passing of this new law, Texas becomes the tenth state to enact a consumer data privacy law. The TDPSA is similar to the Virginia Consumer Data Protection Act (“TDPSA”). The TDPSA gives Texas residents the rights to know, correct, delete, obtain data, and opt-out of the sale and processing for targeted advertising purposes of their personal information. The enforcement is entirely up to the Attorney General and there is no private right of action for consumers.
