One for the money: Latest Notice of Penalty Offenses takes on deceptive money-making claims
On October 26, 2021, the Federal Trade Commission (“FTC”) issued a new Notice of Penalty Offenses targeting deceptive money-making claims. This notice warns over 1,100 companies that misleading promotions related to gig work, multilevel marketing, and other money-making schemes could lead to fines of up to $43,792 per violation. The FTC is using its penalty offense authority under Section 45(m)(1)(B) of the FTC Act, which allows the agency to penalize companies that knowingly engage in deceptive practices after being formally notified. This move aims to crack down on false advertising and unfair business practices by providing clear legal warnings to affected businesses.
