Montana Consumer Data Privacy Act ("CDPA")
Montana passed the Consumer Data Privacy Act (“MCDPA”), which will take effect on October 1, 2024. With the passing of this new law, Montana becomes the ninth state to enact a consumer data privacy law. The MCDPA gives Montana residents the rights to confirmation and access, correct, delete, obtain a copy, and opt-out of the sale and processing for targeted advertising purposes of their personal information, which is similar to the CCPA and CPRA. The enforcement is entirely up to the Attorney General and there is no private right of action for consumers.
