What are the Rights for Colorado Residents in the Colorado Privacy Act (“CPA”)?
The CPA defines a consumer as a Colorado resident acting only in an individual or household context. The CPA expressly excludes individuals acting in a commercial or employment context from the definition of consumer, meaning the personal data of employees, contractors, or job applicants is exempt from the CPA. Under the act, Colorado consumers will have the following rights with respect to their personal data:

Right to Opt-out. A consumer has the right to opt-out of the processing of personal data concerning the consumer for purposes of targeted advertising, the sale of personal data, or certain types of profiling.

Right of Access. A consumer has the right to confirm whether a controller is processing personal data and to access the personal data.

Right to Correction. A consumer has the right to correct inaccuracies in the consumer’s personal data.

Right to Deletion. A consumer has the right to delete personal data concerning the consumer.

Right to Data Portability. A consumer has the right to obtain the personal data in a portable and, to the extent technically feasible, readily usable format that allows the consumer to transmit the data to another entity without hindrance.
