Who must Comply with the Florida Digital Bill of Rights (“FDBR”)?
The FDBR applies only to a person who:
A. Conducts business in this state or produces a product or service used by residents of this state; and
B. Processes or engages in the sale of personal data.
Although the FDBR’s general applicability provisions appear to set forth a broad scope, the class of businesses to whom it actually applies is significantly narrowed by its definition of “controller,” which is the type of entity to whom the FDBR’s obligations and prohibitions primarily apply.
