What are the Rights for Virginia Residents in the Virginia Consumer Data Protection Act (“CDPA”)?
The CDPA provides for the following rights to consumers regarding the personal data processed by a controller:
1. Right to Confirmation. Have a controller confirm whether it is processing a consumer’s personal data.
2. Right to Obtain Data. Access the consumer’s personal data and obtain a copy of certain personal data in a portable format.
3. Right to Corrections. Correct inaccurate personal data.
4. Right to Deletion. Delete personal data provided by or obtained about the consumer.
5. Right to Opt-out. Consumers may opt-out of the processing of their personal data for purposes of: (a) targeted advertising; (b) the sale of personal data; (c) or profiling that produces legal or similarly significant effects on the consumer.
