The Telephone Consumer Protection Act (“TCPA”) was passed into law in 1991 and it amended the Communications Act of 1934. It primarily regulates how telemarketers contact consumers and what type of telephone lines are contacted and it provides protections for consumers for unsolicited telemarketing calls, prerecorded calls, auto dialed calls, text messages, and faxes. The TCPA is regulated by the FCC and enforced by the FCC and state attorneys general.
The Telemarketing Sales Rule (“TSR”) was passed into law in 1995. Since then, the Federal Trade Commission (“FTC”) has amended rule in 2003, 2008, 2010, and 2015. The amendments created the Telemarketing and Consumer Fraud and Abuse Prevention Act (“TCFAPA”). With this new legislation, it gives law enforcement tools to combat telemarketing fraud to the FTC and state attorneys general. It also gives consumers additional privacy protections and helps consumers discern the difference between fraudulent and legitimate telemarketing.
