FTC Announces New Business Guidance for Marketers and Sellers of Health Products
On December 20, 2022, the Federal Trade Commission (FTC) announced the release of its Health Products Compliance Guidance, marking the first significant update in nearly 25 years. This revised guide expands upon the 1998 document focused on dietary supplements and now applies to all health-related products. Drawing from over 200 enforcement cases against misleading advertising, the updated guidance includes 23 new examples and emphasizes the necessity of high-quality evidence, particularly randomized, controlled human clinical trials, to substantiate health claims. Additionally, it integrates revisions from other FTC documents related to endorsements and homeopathic drugs, providing marketers and sellers with clearer compliance standards.
