Consumer Review Fairness Act: What Businesses Need to Know
February 2017
In February 2017, the Federal Trade Commission (“FTC”) released a guide regarding the Consumer Review Fairness Act (“CRFA”), which protects consumers' rights to share honest reviews about businesses' products or services, including on social media. The CRFA addresses issues where businesses attempt to suppress negative feedback through contractual clauses that threaten legal action against reviewers. This act ensures that consumers can freely post truthful reviews without fear of retaliation, while also supporting businesses that strive for genuine, positive feedback. The FTC highlighted the following basic tips for complying with the law:
What kind of reviews does the law protect?
What does the Consumer Review Fairness Act prohibit?
What specific conduct is prohibited by the statute?
What can a company do to protect itself from inappropriate or irrelevant content?
What’s the penalty for violating the Consumer Review Fairness Act?
