FTC Issued Enforcement Policy Statement Addressing “Native” Advertising and Deceptively Formatted Advertisements

FTC Staff Also Releases Business Guidance on Native Advertising

The Federal Trade Commission ("FTC") has issued an enforcement policy statement clarifying how consumer protection principles apply to various advertising formats, including "native" ads designed to resemble non-advertising content. The statement emphasizes that advertisements must be clearly identifiable as such to consumers, ensuring they understand when they are viewing promotional material rather than editorial content.
