What are the Rights for Tennessee Residents in the Tennessee Information Protection Act (“TIPA”)?
The TIPA defines a consumer as a Tennessee resident acting only in a personal context. The TIPA provides for the following rights to consumers regarding the personal information processed by a controller:
1. Right to Confirmation. Whether a controller is processing the consumer's personal information and to access the personal information.
2. Right to Corrections. Correct inaccuracies in the consumer's personal information, taking into account the nature of the personal information and the purposes of the processing of the consumer's personal information.
3. Right to Deletion. Delete personal information provided by or obtained about the consumer. A controller is not required to delete information that it maintains or uses as aggregate or de-identified data; provided, that such data in the possession of the controller is not linked to a specific consumer.
4. Right to Obtain Information. Obtain a copy of the consumer's personal information that the consumer previously provided to the controller in a portable and, to the extent technically feasible, readily usable format that allows the consumer to transmit the data to another controller without hindrance, where the processing is carried out by automated means.
5. Right to Opt-out. Opt out of a controller's processing of personal information for purposes of: (a) Selling personal information about the consumer; (b) Targeted advertising; or (c) Profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer.
