Texas has recently updated its data breach notification requirements, tightening the deadline for notifying the state Attorney General (“AG”) about breaches. Under Senate Bill 768, which modifies Section 521.053 of the Texas Business and Commerce Code, organizations must now inform the AG of a data breach involving 250 or more Texas residents "as soon as practicable and no later than 30 days." Previously, businesses had up to 60 days to make this notification. However, the existing 60-day deadline to notify affected individuals remains unchanged. Additionally, covered entities are required to submit their breach reports through an electronic form available on the AG’s website.
