What is the New Jersey Data Protection Act (“NJDPA”)?
The New Jersey Data Privacy Act (“NJDPA”), effective January 16, 2025, makes New Jersey the first state to pass a consumer data privacy law in 2024. It applies to businesses that control or process the personal data of at least 100,000 consumers annually, or 25,000 consumers if they derive revenue or discounts from data sales. Unlike some other privacy laws, the NJDPA has no revenue threshold and also covers nonprofit organizations meeting the criteria. The law excludes data processed solely for payment transactions and does not apply to commercial or employment-related data.
