Online Marketer to Pay $1m to Settle Privacy Violation Charges

Following an investigation by New Jersey Division of Consumer Affairs, digital marketing company, PulsePoint, has agreed to a $1 million settlement for overriding users’ Do Not Track (“DNT”) settings without the consumers’ consent. The complaint alleges that PulsePoint gathered data on consumer browsing and purchasing habits by placing unauthorized cookies on Apple's Safari web browsers; even though the users' privacy settings were set to specifically block cookies from third-party advertisers. The cookies then enabled third-party advertisers to target consumers with ads based on their online activities. Acting Attorney General John J. Hoffman said that the unauthorized, covertly placed cookies resulted in as many as 215 million targeted ads on web browsers used by New Jersey’s consumers, between June 2009 and February 2012.
