Nestle False Ad Suit Questions “All Natural” Labeling

Nestle USA, Inc. is no stranger to lawsuits charging the company with false advertising. The most recent class action lawsuit has been brought against the company for allegedly misleading consumers through use of the phrase “all natural” on two brands of Nestle’s fruit bars. The plaintiff, Marianna Belli, alleges that the fruit bars sold under the Dreyer’s and Edy’s brands are illegally labeled and misleading. She is suing on behalf of a class of health conscious buyers who would not have purchase the products had they known that the “all natural” labeling was misleading. According to the complaint, the fruit bars contain ingredients that, although they are naturally occurring chemicals, they are in fact “artificial” additions because they are specifically “used to preserve food” or add color.
