FTC Guidance: Voluntary Guidelines for Providers of Weight Loss Products or Services

February 1999

The Federal Trade Commission (“FTC”) released guidance Voluntary Guidelines for Providers of Weight Loss Products or Services, which outlines voluntary practices for weight loss providers aimed at promoting transparency, consumer protection, and healthy weight management. It emphasizes the importance of providing accurate information to consumers about weight loss products and services.

A coalition of stakeholders—including health professionals, government, and consumer advocacy groups—aims to guide the public in achieving and maintaining a healthy weight. The guidance highlights:

  1. Healthy Guidelines. Advocates for sensible eating and physical activity.

  2. Obesity as a Disease. Recognizes obesity as a serious condition that can lead to multiple health issues.

  3. Complexity of Weight Management. Stresses that weight management involves both genetic and environmental factors, and cautions against quick-fix solutions.

  4. Lifestyle Factors. Identifies a sedentary lifestyle as a barrier to weight loss.

  5. Caloric Balance: Emphasizes the need to burn more calories than consumed for weight loss.

  6. Behavioral Modification. Encourages ongoing commitment to healthy eating and regular physical activity.

Guidelines for Providers.

  1. Format and Distribution.

    • These guidelines are non-binding and flexible, allowing providers to tailor disclosures to their programs.

    • All disclosures should be clear and prominent, especially for programs requiring advance payments.

  2. Information Content.

    • Staff Qualifications. Providers should disclose the qualifications and training of personnel.

    • Health Risks. Information on the risks associated with overweight, obesity, and specific weight loss programs must be provided.

    • Program Costs. Clear disclosure of all costs, including any non-refundable fees, is essential.

    • Outcome Data. Providers are encouraged to share data on weight loss results and maintenance to aid consumer decision-making.

  3. Health Recommendations.

    • Emphasizes the importance of modest weight loss (5-10% of body weight) for health benefits.

    • Advises that sustained weight loss requires lifelong commitments to healthy eating and regular exercise.

  4. Consumer Rights.

    • Consumers are entitled to accurate, reliable, and non-deceptive information about weight management methods.

The guidelines encourage weight loss providers to operate transparently and ethically, fostering an environment where consumers can make informed choices regarding their health and weight management options. The emphasis is on realistic, healthy practices rather than quick solutions.
