Lower Saxony data protection commissioner issues SCC reminder

Germany's State Commissioner for Data Protection of Lower Saxony Barbara Thiel issued a reminder that companies and other bodies transferring personal data to countries outside the European Economic Area must transition to new standard contractual clauses issued by the European Commission by Dec. 27. Companies "and other responsible bodies must check whether they are still transferring personal data on the basis of the previous standard contractual clauses," Thiel said.

CPRA rulemaking process enters final steps

California Privacy Rights Act final regulations are around the corner. The California Privacy Protection Agency's approval of modifications to draft regulations and subsequent initiation of a public consultation concerning those modifications mark one of the last steps to what's become an unexpectedly drawn out process. Included in the updates to the draft rules was language for consideration of a potential enforcement delay where deemed appropriate in connection to the CPPA's slower drafting.

ANPD seeks input on simplified registration of personal data processing operations

Brazil’s data protection authority, the Autoridade Nacional de Proteção de Dados, is seeking opinions on a simplified registration model of personal data processing operations for small handling agents. The input period will be open until Dec. 4. Small handling agents include small businesses, startups and nonprofit entities. “The objective is to collect contributions from society for the elaboration of the model,” the ANPD said.

In this week’s global legislative roundup, the U.K. Information Commissioner’s Office issued a warning to the Department of Education for mishandling millions of students’ personal data. The U.S. Securities and Exchange Commission reached a $26 million settlement with a solar energy company over a data breach. The Canadian Minister of Innovation, Science and Industry touted the new privacy standards the country’s proposed comprehensive privacy bill would set. And the European Union finalized the text of the proposed EU Artificial Intelligence Act.

US lawmakers ask Google, Apple if they plan to ban TikTok

Members of the U.S. House of Representatives issued letters to Apple and Google questioning their policies “regarding TikTok and other … apps that could pose privacy threats,” MediaPost reports. In a letter to Google CEO Sundar Pichai, U.S. Reps. Jan Schakowsky, D-Ill., and Gus Bilirakis, R-Fla., asked if the company was planning to remove TikTok and other harmful applications from its Play Store. Apple CEO Tim Cook received a similar letter.

FTC settlement leaves Twitter’s privacy protections under the microscope

Twitter's $150 million settlement with the U.S. Federal Trade Commission prior to Elon Musk's purchase of the platform, leaves its privacy and data security protections under heavy scrutiny, Politico reports. Former FTC officials said the commission will closely watch for any activity violating the settlement over Twitter’s improper use of phone numbers for ad targeting.
