Guide for Getting consent to send email
In their guide, they discuss Canada’s Anti-Spam Legislation (“CASL”) that mandates that businesses must obtain consent before sending commercial electronic messages, such as emails or texts. Consent can be either express (explicit agreement) or implied (based on existing relationships). Express consent has no time limit unless revoked, while implied consent is time-sensitive and generally applies for up to two years after the last interaction, or six months for inquiries.
Businesses must ensure their messages include specific information, such as contact details and an unsubscribe option, and must act on unsubscribe requests within ten business days. Additionally, organizations must comply with both CASL and the Personal Information Protection and Electronic Documents Act (“PIPEDA”) regarding personal information.
