The need to maintain comprehensive record of processing activities only "increases with the business' size and complexity of its processing activities," BP Data Privacy Counsel Helga Turku, CIPP/E, writes. Turku recommends building a ROPA that is "user-friendly and easy to maintain." To accomplish this, she said a comprehensive ROPA should include leveraging "existing processes to capture processing activities systematically" and creating "a standard naming convention."Full story

US states look toward privacy safeguards for brain-scanning tech

Colorado and Minnesota are looking to introduce laws to protect consumer data from brain-scanning technology, Bloomberg Law reports. "Lawmakers are going to need to figure out how the biological and neural data bill interacts with both the underlying (Colorado Privacy Act) and its regulations, as well as any other potential biometric bills that might pass this session," Future of Privacy Forum Senior Policy Analyst Jameson Spivack said.

CPRA rules enforcement delay lifted

The California 3rd District Court of Appeals ruled in a 3-0 decision to allow the California Privacy Protection Agency to immediately begin enforcing its first set of California Privacy Rights Act regulations following a prior court-ordered delay. The rules, finalized since March 2023, cover data processing agreements, consumer opt-out mechanisms, mandatory recognition of opt-out preference signals, dark patterns and consumer request handling.

FTC chair says penalties alone won't stop Big Tech data privacy abuses

U.S. Federal Trade Commission Chair Lina Khan indicated fines alone are insufficient to curb data privacy abuses by Big Tech firms, The Record reports. Khan's comments were made in the context of Meta's lawsuit against the FTC, which is attempting to overturn an agency order mandating the company limit its use of facial recognition technology and a total ban on children's data monetization.

EDPB to discuss 'pay or OK' model at next meeting

The European Data Protection Board will discuss whether to take a formal position on the "pay or OK" advertising model, which allows Meta Platforms users to opt-out of targeted advertising by paying for a subscription, at its 13 Feb. meeting. The board will also discuss a potential draft opinion on a company's main EU establishment and designation of an EDPB representative to the EU-U.S.
