EU-US Trade and Technology Council reaffirms 'risk-based approach to AI'

TikTok requests Illinois court hear privacy lawsuits

TikTok requested the lawsuits accusing the platform of accessing user data through third-party websites be heard in the U.S. District Court for the Northern District of Illinois, Axios reports. Co-lead of Dykema's Biometric Information Privacy Act practice team Melanie Chico, who specializes in Illinois privacy laws, said TikTok is asking the court if the claims are covered under a USD92 million settlement approved in 2022. Full Story

California data broker bill clears first chamber

California SB 362, the Delete Act, passed out of the Senate and moved to cross-chamber consideration. The bill brings data broker requirements and limitations, including broker registration with the California Privacy Protection Agency and a streamlined broker deletion request mechanism facilitated by the agency. "The Delete Act is based on a very simple premise: Every Californian should be able to control who has access to their personal information and what they can do with it," state Sen. Josh Becker, D-Calif., said.

Microsoft updates search engine's cookie policy to comply with CNIL order

Microsoft announced it updated the cookie policy for its Bing search engine following a reprimand by France's data protection authority, the Commission Nationale de l'Informatique et des Libertes, GovInfoSecurity reports. In December 2022, the CNIL fined Microsoft 60 million euros "for misleading cookie policies that it says made it difficult for Bing users to decline data collection." Full Story

Berlin DPA fines bank over automated decision-making

The Berlin Commissioner for Data Protection and Freedom of Information fined an unnamed bank 300,000 euros for violating transparency obligations under the EU General Data Protection Regulation in an automated decision rejecting a credit card application. "When companies make automated decisions, they are obliged to justify them in a valid and comprehensible manner," Commissioner Meike Kamp said.
