Conducting effective PIAs amid the swell of US state privacy laws

As more U.S. state privacy laws come online, private enterprises will be required to conduct privacy impact assessments. Companies that conduct effective PIAs will be better suited to identify risks associated with certain data processing activities that could run afoul of privacy laws in other jurisdictions, Tueoris Senior Privacy Consultant Camille Ley writes. She said steps for managing comprehensive PIAs include generating a project description, assessing data processing needs, and estimating data protection and privacy risks.

Understanding scope, requirements of Florida's Digital Bill of Rights

Florida is on its way to finalizing targeted privacy legislation after attempts to pass comprehensive legislation failed in recent years. Florida SB 262, the Florida Digital Bill of Rights, leaves companies to examine whether they must adhere to any or all proposed requirements based on varying coverage thresholds within the bill, which is pending the governor's approval.

Texas Legislature finalizes comprehensive privacy bill

The Texas Legislature signed off on final text for a proposed comprehensive privacy bill, HB 4, following a resolution struck between chambers in a conference committee. The bill carries unique applicability standards and requires covered entities to honor universal opt-out signals, perform data protection assessments and establish data processing agreements. The law's effective date is 1 July 2024.

Minister discusses impacts, penalty scheme for India's proposed DPDPB

The Economic Times reports India's Minister of State for Electronics and Information Technology Rajeev Chandrasekhar indicated the proposed Digital Personal Data Protection Bill will bring "deep behavioural changes" to platforms operating in India. Chandrasekhar said businesses already aligned with proposed provisions "have nothing to fear" with the bill. He also discussed the proposed penalty scheme doesn't aim to compete with the EU General Data Protection Regulation and is "sufficient to incentivise every data fiduciary or any platform" to comply with the law.
