Brazil's ANPD seeks legal input for processing children, teens' personal data

Brazil’s data protection authority, the Autoridade Nacional de Proteção de Dados, opened a public comment period for how children and adolescents’ data should be processed under the General Law for the Protection of Personal Data. The topic is subject to debate because there is “a situation of legal uncertainty for treatment agents, due to the lack of definition about which legal hypotheses authorize” the processing of children’s data.

The U.S. Federal Trade Commission's comment period for its Advance Notice of Proposed Rulemaking on commercial surveillance and lax data security practices is still more than a month away. German regional court blocks hospital data transfers to US subsidiary in Luxembourg

The Higher Regional Court of the German city of Karlsruhe overturned the Public Procurement Chamber of Baden-Württemberg decision that would have allowed hospitals’ digital discharge management to store data in Luxembourg. The two municipal hospitals in Baden-Württemberg had a contract to transmit data to a Luxembourg subsidiary of a U.S. company. However, the Karlsruhe court overruled the decision on the grounds transferring data to the U.S.

Upcoming EDPB meeting to feature conversation on consistency mechanism

The European Data Protection Board will discuss its rules of procedure during its upcoming meeting Sept. 12. Also on the agenda is a dialogue about the consistency mechanism for applying the EU General Data Protection Regulation by member state supervisory authorities.
